SB 234 Summary

• Establishes Universal Recycling in Delaware by requiring all waste collection service providers to offer single-stream curbside recycling to single-family residential customers by September 15, 2011, and to multi-family complexes by January 1, 2013.

• Creates the Delaware Recycling Fund financed by a $0.04 per beverage container Recycling Fee (replacing existing deposit system) that funds grants and low-interest loans for recycling infrastructure development.

• Eliminates beverage container deposits effective December 1, 2010, and removes dealer and manufacturer liability for deposits on beverage containers.

• Establishes waste diversion goals of 72% total solid waste and 50% municipal solid waste diverted from landfills by January 1, 2015, increasing to 85% and 60% respectively by January 1, 2020.

• Creates the Recycling Public Advisory Council to advise on recycling initiatives, grant programs, and reporting requirements, with council members representing government, recycling/waste industries, businesses, restaurants, and community groups.
