SB28 - Address Confidentiality Act

• Establishes the Address Confidentiality Program administered by the Delaware Department of Justice to protect victims of domestic violence, sexual assault, stalking, and witness protection program participants

• Provides eligible applicants with a substitute address for receiving mail while keeping their actual residential, school, or work address confidential

• Requires federal, state, and local government agencies to accept the substitute address, except for released offenders on probation/parole and registered sex offenders who must comply with existing registration requirements

• Allows government agencies to request disclosure of actual addresses through a waiver process, with the Attorney General able to review denied waiver requests within 15 days

• Permits emergency disclosure of actual addresses to prevent physical harm or significant economic loss, or for law enforcement purposes when circumstances warrant immediate disclosure

• Establishes criminal penalties for providing false information in applications, fraudulently accessing participant addresses, or unauthorized disclosure of actual addresses

• Effective October 3, 2011
