• Add authority to the Division of Long Term Care Residents Protection to ensure certified nursing assistant (CNA) training programs comply with state and federal statutes and regulations, monitor them regularly, and impose sanctions for violations.

• Grant the Division power to regulate CNA certification by approving curricula, conducting surveys, denying or withdrawing approval from non-compliant programs, and establishing mandatory continuing education requirements.

• Require the Division to publish online pass rates for all approved CNA training programs to provide consumers with transparent information for school selection.

• Authorize the Division to suspend or revoke CNA certificates for cause, including findings of abuse/neglect/mistreatment on the Delaware CNA Registry, suspension or revocation by another state, or obtaining certification through false information.

• Impose civil penalties up to $5,000 per violation against training programs for non-compliance, with daily violations counted separately; collected penalties remitted to the State Civil Penalty Trust Fund with administrative hearing rights for penalized entities.
