SB 38 - Bicycle and Motor Vehicle Safety

• Amends Section 4116 of Title 21 of the Delaware Code to include bicycles in overtaking and passing regulations for motor vehicles.

• Requires drivers of motor vehicles to maintain a reasonable and prudent distance when passing bicyclists traveling in the same direction, with 3 feet established as the minimum safe passing distance.

• Mandates that when a 3-foot passing distance is impossible to achieve, the motor vehicle driver must reduce speed to at least 10 miles per hour below the posted speed limit before attempting to pass the bicycle.

• Supported by the Delaware Bicycle Council and based on similar legislation enacted in Rhode Island.
