Senate Bill No. 99 Summary

• Adds Chapter 32 to Title 11 of Delaware Code to establish procedures for identifying victims and witnesses in criminal proceedings using initials or pseudonyms instead of full names.

• Permits police reports, criminal complaints, warrants, indictments, informations, and court documents to identify victims and witnesses by initials, pseudonym, or other non-name identifiers.

• Requires the Attorney General or investigating law-enforcement agency to maintain confidential records of victims' and witnesses' actual names and identifying information, exempt from Freedom of Information Act disclosure.

• Allows courts to order disclosure of a victim's or witness's name only when required by law or when interests of justice require disclosure.

• Prohibits defendants or respondents from disclosing victim or witness identifying information to anyone other than their attorney or defense team members, with violations prosecuted under Delaware Code §1271.
