Establishes pension eligibility for per diem employees of the Delaware Legislature who have 85 months of credited service and were employed for at least 20 consecutive years, regardless of age.

Adds per diem House and Senate service as creditable service under the state employees' pension plan.

Requires per diem employees hired before July 1, 2007 to pay 5% of final average compensation for each month of service credited before receiving their first pension benefit check.

Provides that service pension for qualifying per diem employees shall be computed as the greater of 50% of final average compensation or the standard formula under the pension plan.

Clarifies that individuals qualifying for a service pension under the new per diem provision are not considered "eligible pensioners" for certain other pension benefits.
