Expands definition of sexual abuse to include any sexual contact, sexual penetration, or sexual intercourse between employees/volunteers and patients or residents, with consent being no defense.

Establishes sexual contact with a patient or resident by facility staff as a Class G felony offense.

Increases penalties for abuse resulting in sexual penetration or sexual intercourse to Class C felony, and upgrades serious physical injury cases from Class D to Class C felony.

Applies protections to patients and residents in healthcare facilities, nursing homes, assisted living facilities, long-term care residences, group homes, psychiatric facilities, and substance abuse/mental health facilities licensed under Title 16.

Permits separate charges and convictions for sexual abuse of patients alongside any other crimes under Delaware Code.
