Establishes the Delaware Health Care Freedom Act declaring that residents have the right to choose or decline any mode of securing health care services without penalty or threat of penalty.

Defines "health care services" as any service, treatment, or provision of product for care of physical or mental disease, illness, or injury, and "penalty" as any civil or criminal fine, tax, fee, or other imposed consequence used to punish or discourage exercise of these rights.

Asserts that only the State of Delaware has legal authority to regulate private health care insurance, systems, plans, and services within its borders, and prohibits state officials from imposing or enforcing penalties that violate this public policy.

Expands the Attorney General's duties under Title 29, §2504(10) to seek injunctive relief to preserve residents' health care freedom rights and defend the State, its officials, and agents if any law or regulation violating the Delaware Health Care Freedom Act is enacted by any government including the federal government.
