Amends Delaware Code Title 18 to incorporate payment procedures for non-network emergency care providers that were previously contained only in Insurance Department Regulation 1301.

Requires insurers to pay non-network emergency care providers directly the highest allowable charge for each emergency service that the insurer allowed any network or non-network provider during the 12 months prior to the emergency service.

Applies the same payment requirement to both HMO plans (§3349) and other health insurance plans (§3565).

Authorizes the Insurance Commissioner to adopt regulations concerning the payment provisions in both amended sections.

Includes a severability clause providing that if any provision is found invalid, other provisions of the Act remain enforceable.
