Requires the Delaware Department of Education to develop and promulgate a uniform statewide cyberbullying policy applicable to kindergarten through grade 12, based on a model prepared by the Department of Justice and public comment.

Mandates that all charter schools and school districts formally adopt the uniform cyberbullying policy as written within 90 days of it becoming final.

Authorizes the Department of Justice to represent public school districts and charter schools in legal actions challenging their adoption or use of the state-mandated cyberbullying policy if the State is also a party and the representation is in good faith and public interest.

Establishes attorney-client privilege for communications and documents related to the Department of Justice's representation decisions and obligations regarding the cyberbullying policy defense.
