Requires persons under 18 years of age to wear an ASTM/SEI certified riding helmet when riding or being a passenger on a horse or pony on public roads, trails, parks, public property, or in public parades/speed events.

Establishes fines of $25 for first offense and $50 for each subsequent offense against parents or guardians who fail to ensure their child wears a required helmet.

Allows courts to dismiss all charges if the violator presents evidence of purchasing or obtaining an ASTM/SEI certified riding helmet after the violation.

Prohibits failure to wear a helmet from being considered evidence of comparative or contributory negligence in civil lawsuits involving injured persons under 18 years of age.

Modifies Title 21 of Delaware Code to add horseback rider helmet requirements to Subchapter XII, which also covers bicycles and other human-powered vehicles.
