HB 185 - Reincorporation of the City of Delaware City

• Completely replaces the existing Charter of the City of Delaware City with a new comprehensive charter establishing a Council-Manager form of government.

• Establishes a five-member at-large City Council with a separately elected Mayor who has veto power and tie-breaking authority in council votes.

• Creates the position of City Manager as the chief administrative officer appointed by the Mayor and confirmed by a majority of Council, with broad powers over city departments and personnel.

• Defines the City's geographic boundaries in detail, including jurisdiction over wharves and docks extending 100 yards into the Delaware River, and establishes an annexation process requiring approval by both property owners and qualified voters.

• Includes comprehensive provisions for property assessment, taxation, budget procedures, municipal bonds, elections, planning and zoning, and initiative and referendum processes for qualified voters.
