DE HB21

Creates the "Volunteer Emergency Responders Job Protection Act" establishing job protections for volunteer firefighters, emergency medical technicians, fire police officers, and ladies auxiliary members of volunteer fire companies.

Prohibits employers with 10 or more employees from terminating, demoting, or disciplining employees absent to respond to Governor-declared State of Emergency events (up to 7 consecutive days) or President-declared National Emergencies (up to 14 consecutive days).

Prohibits disciplinary action against employees absent due to injuries sustained while responding to emergencies as volunteer responders.

Exempts essential state employees, armed forces members, National Guard members, hospital employees, and public utilities/VoIP/cellular service providers necessary for network integrity from the protection requirements.

Allows employers to deduct wages for time away, requires employees to notify employers of absences per employer policy, and permits employees to recover lost wages, benefits, court costs, and attorney's fees through Superior Court action within one year of violation.
