Establishes operating or attempting to operate a clandestine laboratory as a Class B felony under Delaware law.

Defines a clandestine laboratory as any property where chemicals or equipment are assembled, intended to be used, or have been used to unlawfully manufacture a controlled substance or other substance.

Makes persons convicted of operating a clandestine laboratory responsible for all reasonable costs associated with site remediation and cleanup of hazardous substances or contamination.

Defines key terms including "cleanup" (containing, removing, or dispersing substances and contamination) and "remediation" (emergency response to remedy and make safe).

Legislation is modeled after similar clandestine laboratory laws in Pennsylvania and West Virginia.
