HB 289 Summary

• Establishes a prepaid wireless E911 surcharge of 60 cents per retail transaction on prepaid wireless telecommunications service sold in Delaware, to fund the Enhanced 911 Emergency Reporting System.

• Requires sellers to collect the surcharge from consumers and remit collections quarterly to the Division of Revenue, with sellers permitted to retain 3% of collected amounts.

• Applies surcharge to transactions occurring in Delaware based on multiple factors including in-person purchase location, service delivery address, seller's business records, consumer-provided address, or mobile phone number association with Delaware.

• Exempts minimal service amounts (10 minutes or less, or $5 or less) and prepaid wireless service provided through the Lifeline program from the surcharge.

• Designates the prepaid wireless E911 surcharge as the only allowable E911 funding obligation on prepaid wireless service in Delaware, prohibiting any additional state, local, or intergovernmental E911 charges on such service; effective January 1, 2015.
