Establishes § 736 requiring employers to safely destroy records containing employees' personal identifying information by shredding, erasing, or otherwise rendering personal information unreadable or indecipherable.

Defines "personal identifying information" as an employee's name combined with social security number, passport number, driver's license, insurance policy number, financial account number, credit card number, tax/payroll information, or confidential health care information when unencrypted.

Excludes publicly available directories and sources from the definition of records requiring destruction when information is voluntarily consented to by the employee or disseminated under applicable law.

Permits employees who suffer actual damages from reckless or intentional violations to bring civil action against employers for non-compliance.

Takes effect January 1, 2015.
