Replaces the "First Offenders Controlled Substance Diversion Program" with the "Delaware Crime Prevention and Rehabilitation Act," expanding eligibility beyond first-time offenders to all "nonviolent drug offenders" as defined by possession or consumption convictions under specified sections.

Mandates individualized drug treatment and rehabilitation as the primary sentencing component for nonviolent drug offenders, delivered through Department of Health and Social Services Treatment and Rehabilitation Centers in each county.

Provides nonviolent drug offenders up to three opportunities to complete probation terms and conditions; allows courts discretion to waive fines and costs, and permits dismissal of charges upon successful completion without a recorded conviction.

Requires the General Assembly to make annual appropriations sufficient to fund drug treatment and rehabilitation services as determined by the Department of Health and Social Services, with funds deposited into the Substance Abuse Rehabilitation, Treatment Coordination, Prevention and Education Fund.

Mandates annual joint reporting by the Department of Health and Social Services, Department of Correction, and courts on the Act's impacts on incarceration and recidivism rates, with independent analysis also required from the University of Delaware.
