Adds subsection (m) to § 6960 of Title 29 of the Delaware Code to allow contracting agencies discretionary authority to opt out of prevailing wage requirements for public works projects.

Allows school district superintendents and state agency heads (or their designees) to opt out of prevailing wage requirements in their sole discretion for public works contracts or aggregate contracts.

Requires that when a contracting agency opts out, the contract specifications must explicitly state that the project is not subject to prevailing wage requirements.

Defines "contracting agency" as the Superintendent of any school district or the Secretary, Director, or Chief Officer of any state agency, or their designee, authorized to enter into public works contracts.
