Prohibits operation of any healthcare agency or facility without a license from the Department of Health and Social Services if licensure is required under Title 16 of the Delaware Code.

Authorizes the Department to issue orders and close any healthcare agency or facility determined to be operating without a required license.

Imposes an administrative penalty of $5,000 per day for any person who refuses, fails, or neglects to close after notification from the Department regarding licensure requirements.

Allows the Secretary to bring civil action in any court of competent jurisdiction for collection of unpaid administrative penalties, including interest, attorneys' fees, and costs, with the penalty amount not subject to review.
