Public Advocate appointed by Governor with Senate majority consent for a four-year term beginning in the 149th General Assembly, replacing the previous at-pleasure appointment during the Governor's term.

Public Advocate shall principally advocate on behalf of residential and small commercial consumers and may decline to represent commercial or industrial consumers with independent advocacy capacity.

Governor may appoint an Acting Public Advocate in cases of death, resignation, incapacity, or removal of the Public Advocate until a successor is qualified and appointed.

Public Advocate shall provide guidance on energy policy and utility consumer matters upon request from the Governor, Secretary of Department, or General Assembly.

Public Advocate required to submit annual reports to the Governor and General Assembly detailing Division activities and other reports as requested by law.
