Amends Section 1121(18) of Title 16 (Delaware Health and Safety Code) regarding patient and resident transfer and discharge rights from facilities.

Adds "inappropriate level of care" as a valid reason for transferring or discharging patients or residents from facilities.

Requires facilities to accept patients or residents back when transferred to acute care or specialized treatment facilities, once they no longer need that level of care and space is available; if no space exists, they must be accepted into the next available bed.

Defines "specialized treatment facility" to include health care settings licensed or certified under Title 16 Chapters 11, 22, 50, or 51.

Requires the Division to issue an annual report on implementation of the readmission provisions.
