SB 150 Summary

• Restructures the Sustainable Energy Utility (SEU) to be managed by an executive director selected through open competitive process by the SEU Oversight Board, replacing the previous contract administrator and fiscal agent model.

• Expands the SEU Oversight Board to 11 members including the DNREC Secretary, Public Advocate, one General Assembly member, seven gubernatorial appointees, and requires county representation with staggered 4-year terms.

• Establishes an advisory council of 13 members to work with affected energy providers and the Public Service Commission on developing cost-effective energy efficiency, peak demand reduction, and emission-reducing fuel-switching programs.

• Requires affected energy providers (electric and natural gas utilities) to implement energy efficiency and peak demand reduction programs as cost-effective alternatives, with program costs recoverable through annual rate mechanisms approved by the Public Service Commission.

• Mandates DNREC establish regulations by June 30, 2015 for evaluation, measurement, and verification standards for energy savings and requires annual public reporting on statewide electricity and natural gas consumption progress toward savings targets.
