Amends Delaware Code Title 18 to redefine "underinsured motor vehicle" as one where bodily injury liability coverage limits are less than the damages sustained by the insured, rather than limits less than the uninsured motorist coverage limits.

Allows innocent victims of motor vehicle collisions to access their own underinsured motorist insurance benefits when the negligent driver's policy limits are inadequate to cover the victim's actual damages.

Permits insurers to offer up to $100,000 per person and $300,000 per accident (or $300,000 single limit) in additional underinsured bodily injury liability coverage, not exceeding the basic policy's bodily injury liability limits.

Applies only to motor vehicle insurance policies issued or renewed six months after enactment; does not affect existing policies.

Addresses Delaware court rulings that prevented victims from accessing underinsured motorist benefits when the victim's policy limits equaled or exceeded the negligent driver's policy limits.
