Renames Chapter 104 of Title 29 the "Regulatory Flexibility and Oversight Act" to reflect new legislative oversight provisions for state agency rulemaking.

Requires state agencies proposing to adopt or amend enforceable rules and regulations to prepare and publish a regulatory impact statement containing statutory basis, purpose, compliance methods, costs, enforcement mechanisms, and public benefits.

Makes failure to prepare a regulatory impact statement render the proposed rule or regulation null and void and subject to judicial review.

Exempts emergency rules, procedural rules, non-substantive technical corrections, and Delaware Public Service Commission regulations from the regulatory impact statement requirement.

Mandates agencies provide regulatory impact statements to appropriate General Assembly standing committees with oversight responsibility at the time of publication.
