HB 149 Summary

• Repeals Delaware's estate tax effective for estates of decedents dying on or after July 1, 2015.

• Eliminates all provisions of Chapter 15, Title 30 of Delaware Code that impose estate taxes on resident and nonresident decedents.

• Removes the tiered tax rate structure (ranging from 0.8% to 16.0%) that previously applied to Delaware taxable estates.

• Eliminates requirements for personal representatives to file estate tax returns, pay estate taxes, and maintain special liens on estate property for Delaware estate tax purposes.
