Exempts linear water and wastewater utility projects with maximum disturbance width of 30 feet or less and total disturbance of 1 acre or less from stormwater management regulations.

Requires these exempted utility projects to comply with erosion and sediment control regulations adopted by the Department.

Defines "Erosion and Sediment Control" as controlling solid material during land disturbance to prevent transport outside the disturbed area by wind, water, gravity, or ice.

Defines "Stormwater Management" as systems controlling both water quantity runoff volume and rate, and water quality adverse effects from land disturbing activities.

Applies exemptions to both Chapter 40 (general provisions) and Chapter 60 (likely water/wastewater specific provisions) of Title 7 of the Delaware Code.
