Amends Delaware Code Title 14 § 151 to prohibit the Department of Education from using student participation rates in state assessments as a factor in determining school or district accountability ratings or progress ratings.

Prevents student participation rates from being used as a basis for disqualifying schools or districts from safe harbor provisions.

Applies to decisions made by parents to opt out of state assessments, which schools and districts cannot control.

Addresses current federal and state regulations that penalize schools or districts with less than 95% student participation in state assessments.
