HB 282 - Beer Garden Licensing

• Creates a new "Beer Garden" license category for outdoor establishments operating 5-9 months per year that are independent of other licensed establishments.

• Beer gardens must be enclosed with a barrier at least 42 inches high and may sell spirits, wine, or beer by the glass for on-premise consumption; food sales are optional.

• Adds beer gardens to the definition of "Establishment" in Title 4 and to Section 512 licensing provisions for hotels, restaurants, taprooms, and clubs.

• Sets biennial license fee at $2,000 with an additional $100 biennial variance permit fee if the beer garden holder seeks a variance to Rule 42.1.

• Beer garden licensees are not required to obtain a patio permit but may apply for variances to existing rules.
