Amends Delaware Code Title 19, Section 2304 to clarify that workers' compensation exclusivity does not apply to contractual insurance benefits available to employees.

Specifically preserves employee access to uninsured motorist benefits, underinsured motorist benefits, short-term and long-term disability benefits, and personal injury protection benefits in addition to workers' compensation.

Allows State of Delaware employees injured in motor vehicle collisions during employment to access both workers' compensation benefits and the State's automobile insurance coverage.

Responds to the 2016 Delaware Superior Court decision in Simpson v. State of Delaware that found the existing exclusivity provision could unfairly deprive employees of needed benefits.

Takes effect upon enactment into law.
