DE HB62

Converts the Family Court Drug Court Program from an adjudicated program to a pre-disposition, non-adjudicated diversionary program for youth.

Requires youth to enter a plea of delinquency to participate, but the Court must stay adjudication while the child completes the program.

Upon successful completion of all program terms and conditions, the Court must vacate the plea and dismiss all charges, with the dismissal not counting as a conviction or adjudication.

If a youth violates program conditions, the Court may enter a judgment of delinquency and proceed with standard disposition proceedings.

Removes provisions regarding revocation and restoration of driving privileges since youth are no longer adjudicated delinquent.
