Senate Bill 12 Summary

• Adds mandatory minimum sentences for adults convicted of illegal firearm possession who were adjudicated delinquent of violent felonies as juveniles (age 16 or older), closing a current loophole that excludes juvenile convictions.

• Extends mandatory minimum sentences to persons repeatedly convicted of illegal firearm possession under subsection (b), regardless of whether their prohibited status stems from violent felonies or other reasons such as domestic violence misdemeanors.

• Establishes minimum sentences ranging from 3 to 10 years at Level V depending on prior violent felony convictions and timing of the violation.

• Imposes mandatory minimum sentences of 4 to 10 years at Level V for prohibited persons who negligently cause serious injury or death while possessing a firearm in violation of the law.

• Specifies that all sentences imposed under this section are not subject to suspension, good time credits, parole, or probation during the imposed sentence period.
