Senate Bill 120 Summary

• Requires state agencies to submit a "regulatory flexibility analysis" (RFA) to the Registrar of Regulations when proposing regulations substantially likely to impose additional costs or burdens on individuals and small businesses.

• Mandates agencies consider specific methods to reduce regulatory burdens, including less stringent requirements, simplified deadlines, performance standards instead of design standards, and exemptions for small businesses.

• Prohibits publication of proposed regulations in the Register of Regulations unless the proposing agency submits the required RFA and other mandated information to the Registrar.

• Expands the definition of "small business" from enterprises with fewer than 20 employees and under $4 million in gross receipts to those with fewer than 50 employees and under $10 million in gross receipts.

• Requires the Registrar of Regulations, Office of Management and Budget, and Department of State to adopt guidelines by November 15, 2015 to assist agencies in preparing regulatory flexibility analyses; becomes effective January 1, 2016.
