Adds subsection (a)(5) to Delaware Code § 832 making it a class B felony to threaten death upon another person during the commission of robbery in the second degree.

Closes a loophole in robbery first degree statute that previously allowed criminals who threatened to kill someone to receive lesser sanctions than those who threatened to use a weapon.

Robbery in the first degree now applies when a person committing robbery in the second degree causes physical injury to a non-participant, displays or represents possession of a deadly weapon, uses or threatens a dangerous instrument, targets a victim 62 years or older, or threatens death.

Maintains robbery in the first degree as a class B felony designation.
