SB 272 Summary

• Replaces previous food donor immunity law (§6820) with expanded protections covering donors, gleaners, and nonprofit organizations that handle donated food.

• Provides immunity from civil and criminal liability for persons and gleaners donating food in good faith unless injury or death results from gross negligence, recklessness, or intentional misconduct.

• Extends immunity protections to donations made to state agencies (in addition to nonprofit organizations) and includes wild game and gleaned agricultural crops within the definition of protected "food."

• Creates new immunity for persons donating processing services for wild game to nonprofit organizations or state agencies.

• Allows nonprofit organizations accepting donated food to claim immunity from liability, provided the food is distributed without charge and not resold to the public.
