Amends Delaware Code Title 25 regarding the Delaware Uniform Common Interest Ownership Act and its application to preexisting common interest communities.

Allows preexisting common interest communities and approved common interest communities the right to voluntarily amend their governing documents to comply with any or all requirements of the chapter, or to selectively adopt particular sections without adopting the entire chapter.

Clarifies that certain specified sections of the act apply to preexisting communities only with respect to events and circumstances occurring after the effective date, while preserving existing provisions of declarations, bylaws, and other governing documents that do not conflict with the chapter.

Establishes that the Unit Property Act (Chapter 22) governs obligations and procedures for condominiums and cooperatives regarding declarant rights, superseding conflicting provisions in this chapter.

Designates this act as the Benjamin Kuntz Act.
