SB60 Summary

• Establishes the Delaware Transparency and Responsibility Using State Tools (TRUST) Initiative to enhance trust between immigrants and state law enforcement agencies

• Prohibits Delaware law enforcement officers and agencies from detaining individuals solely based on immigration detainers or administrative immigration warrants, or communicating release information after an individual becomes eligible for release

• Prevents law enforcement from stopping, arresting, searching, or detaining persons solely based on citizenship status, immigration status, or administrative immigration warrants in federal databases

• Defines "eligible for release from custody" to include dropped charges, acquittals, completed sentences, posted bond, pre-trial diversion, alternative sentencing, or other state/local law release eligibility

• Permits law enforcement to conduct enforcement activities if an immigration agent presents a valid criminal warrant or if there is a legitimate law enforcement purpose unrelated to immigration enforcement
