Defines "All Terrain Vehicle" (ATV) as a motorized off-highway vehicle with four low-pressure tires, a straddled seat, and handlebar steering, excluding farm vehicles, military/emergency vehicles, and construction equipment

Requires operators of 2-wheel and 3-wheel off-highway vehicles and all passengers to wear U.S. Department of Transportation-approved helmets with chin straps fastened, replacing previous ANSI standards

Mandates helmet use for all ATV operators and passengers under 18 years of age

Prohibits persons under 18 from operating an ATV while carrying passengers or from being a passenger on an ATV unless it was manufacturer-designed for passengers and operated by someone 18 or older

Establishes that violations of the helmet and minor operation requirements cannot be used as evidence of comparative or contributory negligence in civil suits or insurance claims
