Justice of the Peace Court may request Division of Motor Vehicles issue a conditional license to a revoked DUI driver who has not yet been adjudicated guilty, provided the driver is subject to continuous sobriety monitoring.

Conditional license permits operation only to travel to and from work, school, medical appointments, court, or sobriety monitoring appointments.

If driver ceases continuous sobriety monitoring or court determines driver no longer entitled to conditional license, Division must restore full revocation for remainder of revocation term.

Operating a motor vehicle in violation of conditional license restrictions is an unclassified misdemeanor punishable by fine of $28.75 to $230.

Act takes effect upon publication in Register of Regulations confirming creation of a continuous sobriety monitoring program and Office of Highway Safety approval.
