Exempts individuals who do not regularly sell such products and nonprofit organizations qualifying for 501(c)(3) tax exemption

Requires manufacturers to notify Delaware retailers about the law's provisions at least 90 days before the effective date

Establishes penalties of up to $1,000 for first violations and up to $5,000 for subsequent violations, with fines deposited in the General Fund
