Amends Delaware Code § 2801 to allow recovery and use of organs and anatomical gifts from HIV-positive donors for transplant or research when recipients are also HIV-positive, in accordance with federal law.

Creates an exception to the existing prohibition on using organs or tissue from HIV-positive donors, which previously applied to all recipients regardless of their own HIV status.

Establishes that Delaware law will no longer be the only state entirely prohibiting use of HIV-positive organs for HIV-positive recipients, including in research protocols.

Maintains criminal penalties (Class E felony) for violations of testing and use requirements for all other donor-recipient combinations involving HIV or AIDS exposure.
