Requires persons proposing to subdivide or rezone privately owned land subject to pre-application review under Title 29 § 9203 to submit any proposed or existing archaeological resource studies or reports to the Director of the Division of Historical and Cultural Affairs

Defines "rezoning" as modification of zoning classification based on local zoning codes under Title 9 or 22, and "subdivision" as division of land into 2 or more lots

Mandates the Director review submitted archaeological studies or reports and provide comments relating to protection or preservation of archaeological resources before pre-application review begins, unless the Director waives this requirement

Enables the Department of State to better fulfill its duty under existing law to protect and preserve archaeological resources on privately owned lands in Delaware
