SB67 Summary

• Elevates tobacco trafficking offenses to class G felonies with first offense penalties of $250-$10,000 per package (up to $10,000 total) and up to 2 years imprisonment; subsequent offenses carry $500-$30,000 per package (up to $30,000 total) and up to 2 years imprisonment.

• Mandates seizure of vehicles used in tobacco trafficking violations under existing forfeiture provisions in Title 11, Chapter 23.

• Increases the threshold for unstamped tobacco product possession from 10 to 21 packs before triggering tax and stamping requirements, and requires invoices, delivery tickets, and purchase orders for possessing or transporting 21 or more packs.

• Applies enhanced penalties to violations including selling unstamped tobacco products, counterfeiting or reusing tax stamps, refusing Department inspections, and possessing cigarette packages with improperly affixed stamps.

• Takes effect 60 days after enactment.
