HB 110 - Delaware Marijuana Control Act

• Legalizes possession and consumption of up to 1 ounce of marijuana (no more than 5 grams concentrated) for adults 21 and older, with no criminal penalties for compliant personal use.

• Establishes a regulatory framework with a Marijuana Commissioner overseeing licensing and operation of retail stores, cultivation facilities, product manufacturing facilities, and testing facilities, with biennial license fees of $10,000 (varying by cultivation size).

• Imposes a 15% marijuana control enforcement tax on retail sales, with revenues directed to the Marijuana Regulation Fund to cover administrative costs and other purposes determined by the General Assembly.

• Maintains prohibitions on public consumption, driving under the influence, sales to minors, and smoking in areas where tobacco smoking is prohibited; allows employers and certain landlords to restrict marijuana use.

• Allows expungement of prior marijuana possession convictions for individuals without violent felony convictions and requires mandatory adoption of regulations within 9 months of enactment.
