HB 167 Summary

• Amends the Administrative Procedures Act notice requirement to include regulatory flexibility analysis and economic impact statements when agencies propose new or amended regulations.

• Creates a new Economic Impact Statement requirement for proposed regulations with adverse effects on small businesses, including identification of affected businesses, compliance costs, and less-intrusive alternatives.

• Establishes a mandatory periodic regulatory review process requiring agencies to review all existing regulations within 4 years of enactment and newly adopted regulations every 5 years to minimize economic impact on small businesses.

• Requires agencies to conduct at least one public hearing per county during regulatory review periods and accept public input via multiple methods including in-person, mail, fax, and online submission, with procedures for anonymous submissions.

• Directs the Registrar of Regulations, Department of State, and Office of Management and Budget to develop guidelines by November 15, 2015 to assist agencies in preparing regulatory flexibility analyses and economic impact statements.
