Allows restricted access to a deceased person's safe deposit box held solely in their name before a personal representative is appointed, specifically to retrieve wills and declarations of last remains

Requires persons seeking access to present the safe deposit box key or combination, a certified death certificate, and proof of identity (with a photocopy of ID to remain in the box)

Mandates that all access occur under supervision of a financial institution employee, with photocopies of removed documents placed in the box before originals are taken

Requires any will removed from the box to be sent to the Register of Wills if the decedent was domiciled in Delaware at death, while declarations of last remains may be released directly to the person seeking access

Protects financial institutions from liability for loss of safe deposit box contents when access is granted under this section, and allows them to charge reasonable fees for photocopying and mailing

Takes effect 60 days after enactment into law
