Patients may decline to view the ultrasound image or listen to the fetal heart tone, and physicians must obtain patient signature confirming the offer was made.

Intentional failure to comply with ultrasound requirements constitutes a Class A misdemeanor and allows civil malpractice actions, professional disciplinary action, and wrongful death claims.

Known as "The Woman's Ultrasound Right to Know Act" with civil court protections including plaintiff anonymity options and attorney's fee awards for prevailing parties.
