Secretary of the Department of Transportation may order traffic control devices establishing maximum vehicle weight limits and prohibiting trucks or commercial vehicles on specific highways.

Secretary must submit weight and size restriction orders to the Registrar of Regulations for publication in the Register of Regulations and on the Department's website.

Violations of weight restriction orders carry fines of $250-$450 for first offense and $500-$650 for subsequent offenses, plus excess weight fines of 2.3 cents per pound (up to 5,000 lbs) and 5.75 cents per pound (over 5,000 lbs) for first offense, doubled for subsequent offenses.

Violations of commercial vehicle prohibition orders carry fines of $250-$450 for first offense and $450-$650 for subsequent offenses, with possible imprisonment up to 30 days for first offense and 60 days for subsequent offense.

Subsequent violations of traffic control devices at the same location constitute moving violations, resulting in license point assessments by the Department.
