Prohibits importing, exporting, buying, selling, transporting, distributing, or propagating invasive plants in Delaware without prior written approval from the Secretary of Agriculture.

Secretary may approve restricted activities only for disposal, control, research, education, or export for those purposes.

Establishes a mandatory Invasive Plant List containing 37 specific species (including Japanese knotweed, Japanese barberry, and English ivy) maintained with advice from the Delaware Native Species Commission.

Requires plants on the watch list of potentially invasive species to be labeled as such when sold at retail or wholesale outlets.

Violations subject to civil penalties of $50-$500 per occurrence, with offenders given opportunity for compliance and administrative hearing before penalties imposed; effective July 1, 2022.
