Establishes civil penalties for intentionally releasing balloons: $25 minimum for first violation of releasing 1-4 balloons, and $75 plus up to 8 hours community service for subsequent violations within 2 years.

Defines "mass release of balloons" as intentional release of 5 or more balloons at one time, with penalties of $250 minimum and up to 8 hours community service for first violation, and $350 minimum plus up to 25 hours community service for subsequent violations.

Exempts from penalties balloons released for scientific/meteorological purposes under government contract, hot air balloons that are recovered, balloons remaining indoors, water balloons recovered after recreational use, and balloons unintentionally or negligently released.

Requires retail and wholesale balloon sellers to display notice stating that intentional balloon release violates Delaware law and is subject to fines and penalties.

Updates the Delaware litter control law definition of "litter" to include 1-4 intentionally released balloons, and clarifies that "release" is an unlawful littering activity.
