Eliminates exemptions that allowed private schools and youth camps to use name-based background checks or opt out of background checks entirely for employees, contractors, and volunteers.

Requires all child-serving entities to conduct fingerprinted Delaware and national background checks through the State Bureau of Identification (SBI) and Federal Bureau of Investigation (FBI), plus Child Protection Registry checks.

Authorizes the Superintendent of State Police to establish regulations permitting re-use of criminal background checks with written authorization from the individual.

Enables the Department of Education to pay background check costs for its prospective employees and clarifies Department of Education's role as an employer in the background check process.

Authorizes SBI to provide subsequent criminal history information through the federal "Rap Back System" to designated entities that received the original background check.
